T & C Demarco Couriers accepts no responsibility, in the event that our van breaks down, is involved in an accident, or an act of God takes place, making us miss any deadlines!
About Demarco Couriers
Demarco Couriers is the trading name of Demarco Leisure. Throughout these Terms and Conditions, references to “Demarco Couriers”, “we”, “us” or “our” refer to Demarco Leisure trading as Demarco Couriers. References to “you” or “your” refer to the person or business making a booking with us or arranging for goods to be collected or delivered.
By making a booking with Demarco Couriers, you agree to these Terms and Conditions.
Bookings
All courier services must be booked in advance and are subject to availability. When making a booking, customers are responsible for providing accurate and complete information, including collection and delivery addresses, contact details, preferred collection and delivery times, the nature and approximate size of the goods, and any special requirements.
We reserve the right to refuse a booking where the requested service is unsuitable, unsafe or outside the services we are able to provide.
A booking is considered confirmed once Demarco Couriers has accepted the booking and, where applicable, the agreed price has been confirmed.
Collection and Delivery Times
Any collection or delivery times provided by Demarco Couriers are intended as estimates unless a specific time has been expressly agreed in writing as a guaranteed service.
We will make reasonable efforts to collect and deliver goods within the agreed timeframe. However, circumstances outside our reasonable control may result in delays. These may include traffic congestion, road closures, severe weather, accidents, mechanical failure, delays at collection or delivery addresses, industrial action, or other unforeseen circumstances.
Where a delay occurs, we will make reasonable efforts to keep the customer informed.
Customer Responsibilities
Customers are responsible for ensuring that goods are appropriately packaged, securely closed and suitable for transportation unless Demarco Couriers has expressly agreed to provide packaging.
Goods should be ready for collection at the agreed time. The sender must ensure that the person handing over the goods is authorised to do so.
Customers must provide accurate collection and delivery information and inform us of any relevant access restrictions, parking difficulties, stairs, lifts, restricted delivery areas or other circumstances that could affect the collection or delivery.
Additional charges may apply where incorrect information, waiting time, restricted access or other circumstances result in additional work or delays.
Goods We Carry
Customers must inform Demarco Couriers of the contents of any package before collection where requested.
We reserve the right to refuse to carry goods that we reasonably consider to be dangerous, illegal, inadequately packaged, unsuitable for transport or likely to cause damage to our vehicle, our staff or other goods.
Unless expressly agreed in advance, we do not carry hazardous, explosive, flammable, illegal or otherwise prohibited goods.
Customers remain responsible for ensuring that the transportation of their goods complies with all applicable laws and regulations.
Packaging and Fragile Items
Goods should be packaged appropriately for normal handling and transportation. Fragile, valuable or particularly delicate items should be clearly identified and suitably protected.
Demarco Couriers will take reasonable care when handling goods but cannot accept responsibility for damage that results from inadequate, unsuitable or defective packaging or from the inherent nature of the goods.
Where customers provide their own packaging, responsibility for the suitability of that packaging remains with the customer.
Loss or Damage
We will take reasonable care of goods while they are in our possession. If goods are lost or damaged while being transported, customers should notify Demarco Couriers as soon as reasonably possible and provide relevant details and evidence of the issue.
Any claim relating to loss or damage should be made promptly and may require supporting information, including photographs, receipts, proof of value or details of the condition of the goods before collection.
Our liability will be subject to applicable UK law and these Terms and Conditions. Nothing in these Terms and Conditions is intended to exclude or restrict any liability that cannot legally be excluded or restricted.
Valuables and High-Value Goods
Customers must inform us before booking if a consignment contains particularly valuable, fragile or unusual items.
Unless specifically agreed in advance, Demarco Couriers does not accept responsibility for the full replacement value of high-value goods where their value has not been disclosed to us before the booking is accepted.
Customers should arrange their own appropriate insurance where required.
Waiting Time
The agreed price generally assumes that goods will be ready for collection and that the delivery location will be accessible.
Where our driver is required to wait for an unreasonable period because goods are not ready, the recipient is unavailable, access is restricted or there are other circumstances outside our control, an additional waiting charge may apply.
We will make reasonable efforts to contact the customer or recipient before leaving a collection or delivery location.
Delivery
Goods will normally be delivered to the address provided at the time of booking.
Where a recipient is unavailable, we may attempt to contact the sender or recipient to agree suitable alternative arrangements. Additional charges may apply for a further delivery attempt where the failed delivery was caused by circumstances outside our control.
We may require confirmation of delivery where appropriate.
Payment
Payment must be made using the payment method and within the timeframe agreed at the time of booking.
Where payment is not received when due, Demarco Couriers reserves the right to suspend or refuse further services until outstanding amounts have been paid.
Any additional charges incurred as a result of changes to the original booking, waiting time, additional mileage, failed delivery attempts or other additional services will be explained to the customer where reasonably possible.
Cancellations
Customers should provide as much notice as possible if they need to cancel or amend a booking.
Cancellation charges may apply depending on how much notice is provided and whether Demarco Couriers has already incurred costs or allocated a vehicle and driver to the booking.
Any cancellation terms applicable to a specific booking will be communicated to the customer at the time of booking where relevant.
Circumstances Outside Our Control
Demarco Couriers will not be responsible for delays or failure to complete a service where this is caused by circumstances that are outside our reasonable control.
These may include, but are not limited to, severe weather, flooding, road closures, major traffic disruption, accidents, mechanical breakdown, vehicle restrictions, delays caused by third parties, industrial disputes, emergency services activity, government restrictions or other unforeseen events.
Where reasonably possible, we will take appropriate steps to minimise the impact of such circumstances and keep the customer informed.
Subcontractors and Third Parties
Where appropriate, Demarco Couriers may use trusted subcontractors or third-party service providers to assist with the delivery of a consignment.
Where a subcontractor is used, we will take reasonable care in selecting an appropriate service provider. The use of a subcontractor does not affect the customer’s statutory rights.
Right to Refuse or Stop a Delivery
Demarco Couriers reserves the right to refuse to collect or deliver goods where we reasonably believe that doing so would be unsafe, unlawful, impractical or likely to put our driver, members of the public, the vehicle or other property at risk.
If goods are found to contain prohibited or undeclared items, we may refuse to transport them and may notify the appropriate authorities where legally required.
Complaints
We aim to provide a reliable and professional courier service. If you have a complaint about our service, please contact us as soon as possible with details of the issue.
We will investigate complaints fairly and aim to resolve them as quickly as reasonably possible.
Changes to These Terms
Demarco Couriers may update these Terms and Conditions from time to time to reflect changes to our services, business practices or legal requirements.
The Terms and Conditions applying to a booking will be those in force and communicated to the customer at the time the booking is made.
Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any dispute arising in connection with our services will be subject to the jurisdiction of the courts of England and Wales, except where applicable law provides otherwise.
